Terms and Conditions of GOGOX Moving Service

1. These terms and conditions apply to your use of GOGOX’s GOGOX Moving Service (the Moving Service).

2. By registering your interest for the Moving Service and by continuing your use of the Moving Service, you acknowledge that you have read, understood and agreed to be bound by these terms and conditions, and the GOGOX terms and conditions set out at https://www.gogox.com/terms/ (these terms and conditions and the GOGOX terms and conditions are collectively referred to as the Terms and Conditions). Please review these Terms and Conditions carefully and do not use the Moving Service if you do not agree with these Terms and Conditions.

3. In these Terms and Conditions, capitalized words in these terms and conditions have the same meaning as the capitalized words in the GOGOX terms and conditions, unless otherwise defined or the context requires otherwise.   

4. You will be required to register your interest for the Moving Service through dedicated channels we have set up from time to time. You will be contacted by GOGOX whereupon a quotation for the Moving Service will be provided (the Quotation). The Quotation will set out the total fees for the provision of the Moving Service (the Service Fee) and is inclusive of all parking and ERP charges (if applicable), and Goods and Services Tax, but exclusive of any other fees and charges not expressly included under these Terms and Conditions. 

5. You will be required to pay a deposit (Deposit) in an amount and by a certain date and time designated by us to confirm the Moving Service to be provided to you. The Deposit is non-refundable, and cannot be resold, exchanged, or transferred and will be a part of the total Service fee. By paying the Deposit, you acknowledge and agree to the Quotation (including all subsequent amendments as further set out under clause 7 of these Terms and Conditions) and the Service Fee.

6. Unless otherwise agreed between you and the Participating Provider who provided the Moving Service (the Mover), you will pay the Service Fee less the Deposit directly to the Mover upon completion of the Moving Service. In the event you fail to pay the Service Fee to the Mover by the designated time, you acknowledge and agree that we are entitled to collect any outstanding amount from you on behalf of the Mover.

7. You acknowledge that the Quotation and Service Fee are subject to amendment if the actual items, lists, information, and/or the requirements for the Moving Service is different from those items, lists, information, and/or the requirements provided to us at the time of and for the purposes of issuance of the Quotation. In such circumstances, we reserve the right to amend the Quotation and charge any additional fees based on the actual circumstances.

8. You acknowledge and permit the Mover to conduct a free onsite visit (Onsite Site Visit) at the premise(s) required for such Moving Service, in order to provide you with an evaluation and updated Quotation (as mentioned in clause 7 above). If you are not available for the Onsite Site Visit, you should inform us to arrange for an online site survey through a video call (Online Site Survey). 

9. Whenever any additional license and/or or permits are required in order for the Mover to provide the Moving Service, including but not limited to, warehouse entrance passes, customs fees and/or premise’s management deposit fees, you acknowledge and agree that you shall be responsible for such license and/or permit and you shall arrange and provide such license and permits prior to or during the provision of the Moving Service. If the Mover is refused entry to any premises as part of the provision of the Moving Service due to your failure to procure such appropriate additional license and/or permits, GOGOX reserves the right to charge an additional administrative fee of up to 50% of the Service Fee and/or any additional fees including but not limited to such fees as required to procure such additional license and/or permits, fees as a result of driver detention, and/or storage fees.

10. Additional fees apply if the Moving Service requires or involves the need to move any items: (a) using stairs (including the need to carry any item up and/or down any stairs or the need to take any stair or steps in order to reach a lift), (b) through a podium in order to reach a lift, (c) more than 50 meters to and/or from the loading or unloading area; (d) up and/or down slopes; (e) the installation or removal, dismantling of the item(s), and/or (f) any other requirements which are not expressly set out under these Terms and Conditions and the Quotation. In any event, the Moving Service will not include any water, electricity or gas pipe connection or disconnection services.

11. Any individual item to be moved (together with any packaging, such as cartons, plastic boxes, bags, travel suitcases, or any other package material) should not weigh more than 25KG. Any relevant item exceeding 25KG will incur additional Service fees up to twice the standard price per such individual item.

12. Prior to the Moving Service, You must: a) pack all items that need to be moved along with any sundries into bags or boxes for handling and moving, it being understood that the Movers shall not be packing for you; b) clear away any sundries within item(s) to be moved (such as loose items in cabinets), the failure of which may result in additional Service fees being charged for that particular item, and we and/or the Movers will not compensate you for any loss and/or damage to that item caused by any sundries not so cleared; c) before and immediately after the Service, count and confirm the number of the items handled and moved. In the event of any discrepancy or question, you acknowledge and agree that you will raise such discrepancies or questions to the Movers immediately on site. GOGOX and the Movers will not accept any questions regarding discrepancies or any other matters raised by you after the Movers have left the relevant site to which the items are moved from or to.

13. In no event will the Moving Service include the moving of the following:

a. any person and/or animal;

b. items of extraordinary value or items that are irreplaceable;

c. hazardous materials including but not limited to: explosives, gases, flammable liquids, flammable solids, poisonous or infectious substances, radioactive material, corrosives;

d. firearms, ammunition, or other explosive materials;

e. any items prohibited to be transported under Relevant Laws;

f. jewellery, objects of art, currency, documents, items of unusual value, or rare metals, unless otherwise agreed by GOGOX or the Mover in writing.

g. any truckload shipment which exceeds any weight limit gazetted by Land Transport Authority (LTA) and Singapore Traffic Police (TP) or which occupies more than the full visible capacity of the vehicle which is provided or size of vehicle that have been booked prior to the pick up date, even if the vehicle provided may be able to carry such load.

h. any other item(s) that the Movers at their sole discretion refuse to handle, transport, and/or move.

14. If you intend to cancel or change the date and/or time of the Moving Service, you shall notify us no later than two business working days BEFORE the scheduled Moving Service date (Notice Period) and any such cancellation or modification of the date and/or time of the Moving Service shall be subject to our prior consent. In the event you require the cancellation or modification of the Moving Service after the Notice Period, we reserve the right to forfeit Your Deposit and to charge you an additional administrative fee of SGD100 or 20% of the total Service fee, whichever is higher. We reserve the right of final decision if any confirmed Moving Service is subject to modification or cancellation due to weather or any other force majeure events beyond our reasonable control.

15. While we will endeavour to procure the Moving Services at reasonable and normal business hours, the time required to complete the Moving Services may vary depending on actual circumstances and we and/or the Movers shall not be held liable for any loss and/or damage caused by any delay in the performance of the Moving Service.

16. GOGOX does not warrant and accepts no liability in connection with items moved and/or handled by the Movers. Any claim arising from damage to such property shall be handled by and between the relevant Mover and you directly. Notwithstanding the aforesaid, we may at our sole discretion provide continued customer service to assist with communication between you and the Mover, and/or offer goodwill reimbursement to compensate any loss incurred by you during the provision of the Moving Service by the Mover. The maximum amount of such goodwill reimbursement is capped at SGD500. If you require protection against losses that may arise out of the Moving Service, you should purchase your own insurance at your own cost. The goodwill reimbursement under this clause is subject to any additional procedure or policy set out in the Quotation. In the event of any dispute, we reserve the right of final decision for the goodwill reimbursement. For the avoidance of doubt, our provision of such goodwill reimbursement to you shall not be construed as any acceptance of potential or actual liability by us for the Moving Service.

17. Without prejudice to your indemnity obligations under the GOGOX terms and conditions, you agree and undertake that you shall, on demand, keep fully indemnified and hold us and the Mover harmless for any fines resulting from the provision of the Moving Service to you in relation to excess weight or dimension of any items moved that cause us or the Mover to be in violation of any Relevant Laws, except in relation to fines incurred for equipment defects that are the responsibility of the equipment owner (such as fines resulting from defects of the vehicle used by the Mover as part of the Moving Service). 

18. For the avoidance of doubt, to the extent you may be requesting the Moving Service for or on behalf of any other person, GOGOX is entitled to assume that you are authorised to do so and that you shall remain responsible to pay for the Moving Service and these Terms and Conditions continue to apply to you and your request for the Moving Service. 

19. We reserve the right to amend these Terms and Conditions at any time without further notice to you, and may cancel or terminate the Moving Service at any time without prior notice and without any liability to you when You are in breach of the Terms and Conditions. We recommend you to read these Terms and Conditions periodically.

20. Upon registering your interest for the Moving Service, you agree to provide to us your personal data for the purposes of our provision of the Moving Service to you (including passing your personal information to Movers in relation to the Moving Service). 21. These Terms and Conditions supersede all oral or written agreements and commitments between you and us in relation to the Moving Service. 

22. These Terms and Conditions are governed by the laws of Singapore and in case of any dispute in the interpretation of these Terms and Conditions, We reserve the right of final decision. Any disputes, actions, claims or causes of action arising out of or in connection with these Terms and Conditions (Disputes) or the Moving Service shall be referred to the Singapore International Arbitration Centre (SIAC), in accordance with the Rules of the SIAC as modified or amended from time to time (the Rules) by a sole arbitrator appointed by the mutual agreement of you and GOGOX (the Arbitrator). If you and GOGOX are unable to agree on an arbitrator, the Arbitrator shall be appointed by the President of SIAC in accordance with the Rules. The seat and venue of the arbitration shall be Singapore, in the English language and the fees of the Arbitrator shall be borne equally by you and GOGOX, provided that the Arbitrator may require that such fees be borne in such other manner as the Arbitrator determines is required in order for this arbitration clause to be enforceable under Relevant Law. Notwithstanding the above, you may choose to submit a Dispute for mediation at the Singapore Mediation Centre and/or Small Claims Tribunal, subject to their respective rules and guidelines.
